GlowForms is intended only for professionals operating a business. By creating an account, you confirm that you are at least 18 years old and authorized to represent your business. Each account must have a single Account Owner who is responsible for the account and all data associated with it.
You may not maintain an account if you are under the age of 13. Accounts for individuals under the age of 18 require parental consent.
COPPA Compliance: GlowForms does not knowingly collect personal information from children under 13. If we discover such data has been collected, it will be deleted in compliance with the Children's Online Privacy Protection Act (COPPA).
Section 2 – Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.
You must not transmit any worms, viruses, or code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.
Section 3 – General Conditions
We reserve the right to refuse Service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission by us.
Section 4 – Payments & Subscriptions
Subscriptions are available on a monthly or yearly basis. All fees must be paid in advance and are non-refundable, including if you cancel before the end of your billing cycle.
Your subscription will automatically renew unless canceled before the next billing date. You must cancel before the renewal date to avoid charges for the following cycle.
We reserve the right to adjust fees at any time with at least 14 days' notice.
Section 5 – Client Data & Privacy
When you use GlowForms to collect information from your clients, you act as the data controller and are fully responsible for deciding how and why that information is used. GlowForms acts solely as a data processor, securely storing, transmitting, and making the information available to you.
Security & Compliance
Your client data is protected with industry-leading security standards. GlowForms is GDPR and HIPAA compliant, ensuring we meet all relevant regulatory requirements for privacy and data protection.
GlowForms handles all personal data in compliance with applicable privacy laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). These Terms incorporate by reference our Privacy Policy and Data Processing Addendum (DPA).
We do not use or disclose any information that is considered "sensitive" under applicable law for the purpose of inferring characteristics about you.
Section 6 – Products, Services & Third-Party Tools
Certain products or Services may be available exclusively online. All descriptions and prices are subject to change without notice. We do not guarantee that the quality of products or services will meet your expectations.
We may integrate third-party services such as Stripe for payments, Twilio for SMS, and others. Your use of these features is subject to the terms and privacy policies of those third parties. GlowForms disclaims liability for any issues caused by third-party platforms.
Section 7 – Acceptable Use
You may not use GlowForms to:
- engage in unlawful activity;
- advertise adult content or unlicensed treatments;
- harass, insult, defame, or discriminate;
- submit false or misleading information;
- upload malicious code or spam;
- collect personal data without consent;
- infringe on intellectual property rights.
Each account owner is also responsible for their clients' behavior on GlowForms. We may suspend or terminate services for violations by either you or your clients. Enforcement is at our sole discretion.
Section 8 – Health Data
Some GlowForms products include medical or health intake forms. You are solely responsible for ensuring you are legally permitted to collect and use such information. GlowForms is not liable for compliance with health or medical regulations.
Section 9 – Communications
By using GlowForms, you consent to receive service-related communications from us, including emails, texts, and app notifications.
You may unsubscribe from promotional emails at any time, but you cannot opt out of essential service-related messages.
You represent that any client contact data you provide has been collected with proper consent, and you are solely responsible for complying with laws like the TCPA, CAN-SPAM, and applicable carrier policies.
Section 10 – User Content & Confidentiality
If you submit content to GlowForms (e.g. reviews or feedback), you grant us a royalty-free license to use it for marketing purposes. You must own or have permission to share this content.
Do not upload sensitive personal data (e.g., credit card numbers) into fields not meant for it.
If you submit feedback, suggestions, or feature ideas, we may use them without compensation or confidentiality.
You agree to keep GlowForms' confidential information private.
Section 11 – Account Cancellation & Data Deletion
You may cancel your GlowForms account at any time by following the steps in your account settings or by contacting us at hello@glowforms.com.
Important Notice:
- Canceling your account will permanently delete all data associated with it.
- We do not retain data for unpaid or inactive accounts. If your subscription expires or payment fails, we are not obligated to store or maintain your data.
- Data recovery after cancellation or non-payment is not possible.
Upon termination, your license to use the Service ends, and access to any connected third-party platforms may also be revoked.
Section 12 – Errors & Accuracy
We reserve the right to correct errors, inaccuracies, and omissions. Historical content is provided for reference only and may not be updated.
Section 13 – Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or that the Service will be error-free.
We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Section 14 – Limitation of Liability & Disputes
To the extent allowed by law, our total liability to you will not exceed what you paid us in the 12 months before the event giving rise to the claim.
You agree not to involve GlowForms in disputes between you and your clients.
All disputes will be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA). You waive the right to class actions or jury trials.
Section 15 – Indemnification
You agree to indemnify and hold harmless GlowForms, its affiliates, and partners from claims related to your use of the Services, breach of these Terms, or violation of any law or third-party rights.
Section 16 – Termination
We may suspend or terminate your account for any violation of these Terms. Upon termination:
- All licenses granted to you end
- Any pending transactions may be canceled
- Data retention will follow our Privacy Policy
- You remain liable for unpaid fees
Section 17 – Entire Agreement
These Terms, along with our Privacy Policy and DPA, form the entire agreement between you and GlowForms.
Failure to enforce any provision is not a waiver.
Section 18 – Governing Law
These Terms are governed by the laws of your place of residence, without regard to conflicts of law.
Section 19 – Severability
If any provision is found unenforceable, the rest will remain in full force.
Section 20 – Changes to Terms
We may revise these Terms at any time by posting updates. Continued use of the Service means you accept the new Terms.
Section 21 – DMCA Copyright Policy
If you believe any content on GlowForms infringes your copyright, please send a takedown request to hello@glowforms.com in accordance with the Digital Millennium Copyright Act (DMCA).
Section 22 – AI-Generated Content
Some features may use AI to generate text or suggestions. You are solely responsible for reviewing all output before use.
GlowForms disclaims all liability related to AI-generated content.
